Helvetreis is a Tetris-inspired puzzle game available on Android and iOS platforms. The game was designed in Switzerland and is operated from Switzerland, with the aim to provide the best entertainment experience and to rediscover the good sensations as with the clasic Game Boy.

This privacy policy gives you an overview of the nature of the personal data collected by Helvetreis (hereinafter referred to as “Helvetreis” or “we”) when you visit our website or use one of our mobile applications. It explains how this personal data is processed and to whom it might be transmitted and under which circumstances. It also gives you information on the rights that you have and which you may have recourse to in accordance with data protection. Please read this privacy policy carefully so that you are aware of how your personal data is processed and how you can exercise your rights.

Legal basis

We comply with the principles imposed on us by the Swiss Data Protection Act and its regulations, and, where applicable, European Union data protection laws (GDPR). This means that we are transparent about which personal data we process and for what purpose. We only process personal data that we receive legally and because this is necessary for the fulfilment of the below-mentioned purposes including for general commercial activity. The processing of personal data only takes place based on the appropriate legal basis and as permitted by law. A legal basis may be a contract, your consent, a law or a public interest that authorises us to process the data or a legitimate interest on your behalf.

We therefore inform you here about what we do with your personal data during each data processing operation. If we no longer need your personal data and the law no longer requires us to store it or if you no longer wish us to store and process it, we will cease processing it.

Definitions

There are two categories of data that are processed when using Helvetreis: on the one hand personal data and on the other hand non-personal data.

“Personal data” means any data that relates to your person, that provides information about you and through which you could be personally identified. This includes, for example, your first and last name, postal address, e-mail address, date of birth, telephone number and similar data. Information that cannot be associated with your person or your identity is not personal data. This includes, for example, the username and country provided by customers owning the paid version of our mobile application.

“Non-personal data” is information that cannot be associated with your person or your identity, for example your IP address or the date and time of access to our website. This data is not associated with user profiles, therefore it is not linked to your personal data and thus it is anonymous to us.

The processing of data includes every manipulation of personal and non-personal data. This includes, among other things, entering, collecting, anonymising, storing, administering, using, transmitting, disclosing or deleting your personal data.

Responsibility

We are legally obliged to tell you who is the holder of the data collection. The holder of the data collection is Helvetreis, a registered trade mark owned by Xavier Malagoli in Geneva, Switzerland. Purpose

During the course of your relationship with Helvetreis you may contact us by email, by telephone or in writing. In principle, this is when we collect and process your personal data such as your first name, name, civility (gender), address, including street number, postal code and city, telephone number (landline and/or mobile) and email address, as long as you shared these information details with us at the time you contacted us. We may also supplement any information you provide us with information from sources that are publicly available, including data from third parties such as public registries or social networks (LinkedIn, Facebook, Twitter and others). This information will also be retained by us and treated confidentially.

We process and store your personal data for as long as it is necessary for the following purposes:

  • to provide support if we receive a query from you relating to the use of Helvetreis;
  • for the management and maintenance of our relationship with you;
  • for marketing purposes, i.e. we send you advertising concerning new products and/or services.

You have the possibility to object to any of these processing reasons at any time by following the instructions set out in the section Rights. As a result, we will not collect or process any of your personal data for the purpose of your request in the future.

Third parties

We use the service of Google Analytics and Google AdSense from Google Inc., hereinafter referred to as “Google” (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) to obtain statistics on your visits on our website and to integrate advertisements onto the free version of our application.

Google Analytics uses cookies to collect data such as the time spent on the site, the pages visited, your country or region of connection etc. We collect and process this data in order to continuously improve our products and services and adapt them to your needs, to identify trends and to create and evaluate statistics on the use of our offerings. The statistics that Google provides us with are impersonal. Neither your name, nor your IP address, nor any other information that could allow us to identify you directly is transmitted to us. As a third-party vendor, Google AdSense uses cookies to provide you with a good advertising experience on our application. Cookies are used to enable better advertising, but normally they don’t contain any personal information. They don’t scan your computer or do any kind of investigation to find out your personal information. Any personal information they might contain is a result of your own input on a website’s form. The information thus obtained, in particular your IP address and the advertising formats displayed, is transferred to and stored on a Google server in the USA. Google may also transfer this information to third parties. Since each time you disconnect and reconnect to the internet a new IP address is automatically assigned to your device, IP addresses are not inherently capable of identifying you as an individual. IP addresses, in and of themselves, do not contain any personally identifiable information about you. An IP address does, however, contain information regarding the location of your device on the internet (your country) and the name of your internet service provider. Google will deposit cookies and web beacons on your terminal equipment after every impression, every click and every other activity that leads to a call to the Google Adsense server. If the browser accepts the cookie, it will be stored there. If you do not want this data to be processed, you have the possibility to prohibit the processing of non-personal data at any time by deactivating certain technologies, such as the use of cookies via the settings of your browser. Please note that all publishers are required to adhere to Google policies, and that there is no possibility of objecting to general advertising on the applications.

When you purchase the application Helvetreis, your credit card information and other financial data required to process payment is collected and maintained by third party payment processors. We are not able to collect any additional information beyond that provided by the third party organisations with which you are affiliated.

In addition, your personal data may be transmitted to third parties outside Helvetreis, who may make use on behalf of Helvetreis for technical reasons and/or for the fulfillment of the above-mentioned purposes or for general commercial activity. This can for example be a hosting partner or an IT service provider. These service providers are contractually obliged to process your personal data exclusively in our name and according to our specifications. These service providers are located primarily in Switzerland and the European Union, where appropriate protection of your personal data is provided, meaning that the protection of your personal data is guaranteed.

Please note that we reserve the right to disclose personal data to third parties in accordance with the law, for example to a criminal prosecution authority, in order to pursue and detect illegal activities.

Data security

Helvetreis works with service providers who operate secure data networks that meet the technical standards in force. Adequate technical and organisational measures are put in place to knowingly protect your data against loss, destruction, falsification, manipulation or other unauthorised access by third parties.

Although Helvetreis uses all necessary means to prevent the disclosure of data due to errors in data transfer and/or unauthorised access by third parties, it does not accept responsibility for such undesirable events.

Rights

Your personal data is your property. Therefore you have the right to decide for yourself how your personal data is to be processed. According to Swiss Data Protection Act and its regulations, you have the following rights regarding your personal data:

Right to access: you have the right to know free of charge whether and which personal data Helvetreis processes about you.

Right to rectify: you have the right to rectify your personal data at any time if you notice that incorrect data about you is being processed.

Right to delete: When the processing of your personal data is no longer necessary, e.g. because there is no longer a contractual relationship with Helvetreis, or if you no longer agree with the processing of your personal data, you have the right to demand the deletion of your data.

Right to limit the processing: You have the right to have the processing of your personal data restricted at any time.

Right of opposition: Where we have permission to process your personal data, you are entitled to revoke your consent or express your refusal at any time. If the processing of your personal data is useful for marketing or advertising purposes, you may revoke your consent to the processing of your personal data for these purposes in general or for specific products or services at any time.

Right to appeal: Without prejudice to any other administrative or judicial remedy, you have the right of appeal to a supervisory authority, if you believe that the processing of your personal data does not comply with data protection principles. You may lodge a complaint with a supervisory authority in the country in which your habitual residence or place of work is located or in the place or country where the violation is alleged to have occurred.

For any of these rights to be exercised, you must send us your request by email to privacy@helvetreis.ch with a copy of your identity document, specifying which personal data and which right you are referring to.

Children

Since children are not always aware of the risks and consequences of processing personal data and are probably not aware of their rights in this respect, special protection must be ensured when it comes to their personal data. This also applies, of course, to the use of such personal data for advertising purposes. We support the Children’s Online Privacy Protection Act (“COPPA”) and other frameworks like the Swiss Data Protection Act and the General Data Protection Regulation (“GDPR”). Though children under the age of 13 might be playing our game, no personal data is collected from them unless they contact us directly using their own contact details if they are to own some.

Please remember that when it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (“COPPA”) puts parents in control. Therefore, we encourage parents to discuss with their children why data privacy is important and why parents should be the ones contacting us on behalf of their children whenever they need our support from us.

Furthermore, we have disabled sensitive advertising categories to be displayed in our apps in order to protect children from inappropriate content. Though these categories are intentionally blocked for this specific purpose, please note that some sensitive advertising categories can sometimes overlap with other general advertising categories, thus Helvetreis does not accept any responsibility for such undesirable events.

By continuing to browse Helvetreis website or by downloading Helvetreis mobile application, you declare that you agree to the processing of your personal data in accordance with the provisions of this privacy policy and that you accept this privacy policy.
